1. Ownership
IGT (UK 2) Ltd is a division of IGT, a Public Company listed on the NYSE, ("IGT") company number 4006717 whose registered office is at IGT (UK 2) Limited, Margaret Street, Ashton-under-Lyne, Lancashire, OL7 0QQ, United Kingdom. ("IGT", "We", "Us" or "Our"). IGT (UK 2) Ltd provides online Gaming ("Games") under a Gambling Licence issued to IGT-UK Group Limited by the United Kingdom Gambling Commission ("UKGC").
Your agreement to use any of the Games supplied is with IGT (UK 2) Ltd.
All Games are regulated by the UKGC and run under IGT-UK Group Limited trading as IGT (UK 2) Ltd's licence and subject to the laws of England and Wales. These Terms and Conditions apply to all Games supplied by IGT (UK 2) Ltd whether direct to a Handset or via their website ("Site").
2. Updates
We reserve the right, from time to time, and at Our sole discretion, to change or update certain provisions of these Terms and Conditions accordingly. All changes will be published on Our Site. Each change will become effective upon publication. It is your responsibility to read and understand these Terms and Conditions, and We advise you to come back from time to time to stay up to date. Every instance that you play a Game you agree to be bound by the then current Terms and Conditions.
We also reserve the right to change, suspend or discontinue any aspect of any Game, any element of the Site or any related arrangement without notice or liability.
3. Register
To play any of the Games supplied by IGT (UK 2) Ltd (Games) you must first register with IGT (UK 2) Ltd:
- using the mobile phone (Handset) on which you will play the Games or access your Account and hold an account with Us (which is subject to terms and conditions). To do this you must send a text message to the number advertised, use a WAP link on a WAP site advertised or provided by IGT (UK 2) Ltd; OR
- through the Site, but registering the Handset to which Games will be downloaded and played.
You are responsible for providing the Handset and ensuring the Handset has an appropriate internet connection to facilitate access to the on-line gaming server for the purposes of accessing and playing Games.
By accepting these Terms and Conditions and entering this Site, you're letting Us know that you are at least eighteen (18) years old. We reserve the right to request additional information to double-check this and to ban you from taking part in any Games or winning any money until your age is confirmed. We also reserve the right to cancel and return any stakes placed by minors.
Games are only downloadable to Handsets located in the United Kingdom.
You must not register, or try to register, by Handset or on the Site if you are located in a jurisdiction where registration or playing of any of the Games is against any applicable regulation or where such service is prohibited by the conditions of your mobile network operator service agreement. It is your responsibility to ensure that this is not the case.
You may not register if you are not acting as principal and are acting on behalf of someone else, or if you or a member of your household are or have ever been an employee of IGT or a group company, or are an employee of any of IGT’s third party contractors such as licensors, software suppliers, developers or partners or if you are in any way affiliated with Us.
We reserve the right to request evidence to verify your identity at any time, perform regular security checks and maintain records of all transactions. We may also suspend and/or terminate your account, registration or withhold your payment until We receive the appropriate information that We have requested.
By seeking to register with Us, or by playing any of the Games, you agree that you will comply at all times with the requirements of this section. You also guarantee that all information you provide to Us, either upon registration, subsequently or in connection with your account, is complete, accurate and not misleading. You must inform Us immediately if there is any change to such information. Your registration will not be valid unless you provide Us with the accurate information We ask for.
If you are in breach of this section 3, you will not be entitled to any of your winnings, and your account shall be closed or suspended. We reserve the right at any time, and at Our sole discretion, to suspend or close your account and refund any balance of your account without further explanation.
Any person who willfully or knowingly breaches section 3 is committing fraud and may be subject to criminal and civil prosecution.
IGT (UK 2) Ltd reserves the right to cooperate with law enforcement and other authorities, including the UKGC, in investigating claims of illegal activity on this Site or on your Handset involving any of the Games.
During registration We will request a password for security purposes. The password that you choose must be kept private and secure by you at all times (especially from minors). Failure to do so could lead to unauthorised activities on your account. Transactions made using your account name and password are accepted by Us on the understanding that it is you who is playing the Games. If someone other than you has accessed your account and we are not informed, we accept no liability for monies or information lost.
It's important to note that using the internet and mobile telephony and data services does have its dangers. We take reasonable steps to ensure a fast and reliable service, but we can't be held responsible for the security of Our Site, for any damage, loss of, or corruption of any data, information or material or viruses that may infect your computer, Handset or your equipment or other property, or as a result of any breach of security by hackers as a result of your use of Our Site or any of the Games.
4. Account
You are allowed to hold only one account, using only one of your credit or debit card numbers, at any time on this Site. Multiple accounts are prohibited. In the event that multiple accounts for an individual are identified we reserve the right to remove any and all promotional funds and winnings from the duplicate account. In order to play any of the Games, you must open an account with Us. In order to play “play per spin” mode Games you are required to ensure that adequate funds have been deposited into your account before you begin to play. The minimum account deposit is £5 and must be made by a debit card or credit card. Only stakes placed from your account through this Site will be accepted for the Games. Alternatively, insofar as you are play “tournament” mode Games, then you will be permitted, subject to having registered an account with us, to have charges, and you hereby authorise us to do so, reverse billed to your mobile network operator account which charges will appear on your mobile network operator charges statement as soon as reasonably practicable after incurring such charges. We may offer you a facility to top up your gaming account by applying a charge to your pre-pay account. We reserve the right to withdraw or limit this facility at any time and without notice. You may not use this facility if doing so puts you in breach of the terms of your mobile network operator agreement. If we are advised by your mobile network operator of non-payment, misuse or if payment is withheld by your mobile network operator, we may suspend or cancel your account at any time without warning. Any winnings, in such circumstances, will be forfeit. You may not request a withdrawal of winnings from your account in circumstances where any monies used by you to play Games have been placed with monies not confirmed as billable by your mobile network operator.
All winnings shall be credited to your account. You may access all deposits and withdrawals through the "My Account" page. All funds must be withdrawn based upon the withdrawal procedures set out below. In order to make a withdrawal from your account in excess of £5,000 you will be required to contact Our Customer Services Team. In respect of any winnings in excess of £50 using any Game, verification by Us will be required before such winnings are credited to your account which will be undertaken as soon as reasonably practicable, but which may take up to 72 hours to complete. In addition, We reserve the right to request further information prior to any withdrawals.
Please note specifically as follows:
- Withdrawal by Debit Card, UK Issued MasterCards and VISA credit cards not issued in The Americas and certain other jurisdictions: each withdrawal must be at least £5 (except in the case of a final withdrawal to close an account). Withdrawals may only be made to the card you have registered and deposited funds with. If you are withdrawing £3,000 or more within any 90 day rolling period, you must provide Us with paper copies of your Passport/Driving Licence, AND the Bank or Credit Card Statement that is registered with Us so We can verify your address and personal details.
- Withdrawal by cheque: Where, for whatever reason, we cannot return funds to your registered card, we will issue you with a cheque. Each withdrawal must be at least £5 (except in the case of a final withdrawal to close an account). If you are withdrawing £3,000 or more in a rolling 90 day period, you must provide Us with paper copies of your Passport/Driving Licence, AND the Bank or Credit Card Statement that is registered with Us so We can verify your address and personal details. The cheque will be payable to you and not a third party, and will be sent to you at the address registered with Us. A £2 service charge is payable for withdrawals by cheque and will be deducted from your account at the time of withdrawal.
In the event of a promotional campaign or competition, for which We credit an amount to your account, you will be required to stake your own funds to convert the bonus to case on Our Games. You are not entitled to withdraw these amounts, unless stated otherwise in the terms of the promotional campaign or competition. We reserve the right to reclaim those amounts if you do not use them to play the Games during the times specified in the promotion.
Your account is personal to you, and others are not allowed to use your account, to accept any prize, or participate in any of the Games. Insofar as you or any third party are found to have violated this section you will not be entitled to collect any winnings generated as a result of such violation.
All applicable taxes and fees in connection with any winnings awarded to you, and any other payments to you, are your sole responsibility. Winnings may be used for specific purchases offered by Us to you on the Site. Beyond the specific items available on the Site winnings cannot be transferred, substituted, or redeemed for any other consideration.
It is your sole responsibility to inform Us of any changes to your personal details, including your address, your debit or credit card number, your expiry date or issue number of your card, that may impact upon the use of your account. Failure to inform Us of your changes may result in transactions being declined by your bank, building society or credit card company. This means that you may not get your winnings! We do not accept any liability or responsibility for transactions that are declined as a result of your failure to provide Us with correct details. Please contact Our Customer Service Team to update your details. It is your responsibility to protect your debit and/or credit cards for loss or theft, so please contact Us immediately if your card gets lost or stolen.
We reserve the right, at Our sole discretion, to make changes to the payout rates of the Games. These can be viewed by clicking on the "Pay Table" link on the right hand side of the Game navigation bar within each Game. It is your responsibility to note the payout rate applying to each Game in each session before you play that Game.
Charges, claims and proceedings, both civil and criminal, may be brought against you and any other person(s) in connection with you if you have manipulated, tried to manipulate, tampered with Our service, Games, any of the customer accounts, laundered money, or attempted to launder money on this Site. We reserve the right to pass on any information that We deem relevant, at Our sole discretion, to the appropriate authorities, including the UKGC, if We become aware of, or suspect, that you are involved in any such activities. We are not obligated to provide you with notice of Our intent nor shall We give you reasons for Our doing so. You agree to waive any and all rights you may have, at law or otherwise, of whatever nature and in whatever jurisdiction, connected in any way with such disclosure. In addition, We reserve the right to hold any funds We suspect to be in connection with a financial crime, money laundering or related activity. We shall be under no obligation to provide you with a reason for doing so.
Basis of IGT' Retention of Deposits. Please note that we are not a bank. Monies held in your account do not accrue interest. We do hold all customer deposits in client-specific accounts that are kept separate from the accounts that we use to fund our business, but these client deposit accounts are not trust accounts and in the event of any insolvency or other event of stress affecting our business the deposits held in them may be at risk.
Inactive/Dormant Accounts. Any inactive account where a balance is preserved will be reviewed regularly by us. We will attempt to notify the account holder, via SMS, using the phone number provided to us by the account holder, of any remaining funds held in the inactive account. Should an account remain inactive (for example, where it has no login, gameplay or transactions) for a period of 13 months consecutively or more, we will remove the entire balance and deal with the funds in accordance with the regulations that apply to this service.
5. Customer Service
You may contact Our Customer Service Team at any time if you have questions or need assistance. Just click on the Contact Us button. To provide better service and for your protection, telephone conversations may be recorded and/or monitored by designated staff. You must contact Customer Service if your personal information or credit details have changed. In addition, if you forget your password or suspect that someone else has learned and used your password, please contact Our Customer Service Team immediately. It is your responsibility to keep your password private and secure.
6. Exclusion Orders
At any time, you may instruct Us to exclude you from participation in the Games and close your account. Once your request is processed, your account shall be blocked, no stakes shall be accepted, and your account shall be closed with any outstanding funds credited back to you. Any account that is blocked through use of this Self Exclusion process cannot be revoked unless you contact Us and request a change in your account status. In addition, you may self-regulate your limits by accessing the User Protection link when logged into the Site. Using this facility you can lower and increase your limits at any time. Such increase may not exceed our own limits and is subject always to Our consent.
We reserve the right to exclude any user from Our Site or from accessing and using any of our Games at any time.
7. Games
It is your responsibility to read and understand the rules of each Game . You acknowledge and agree to abide by the rules of each of the Games as published and periodically changed on Our Site or otherwise appearing as part of the Game. The rules referred to for each Game are part of these Terms and Conditions. You can only stake money on Games through your personal account on this Site. We won't accept stakes any other way.
Specific charges associated with any Games will be set out in the relevant rules for that particular Game.
You fully accept and agree that the random number generator software will determine the outcomes of all Games.
We reserve the right to refuse the whole or any part of a charge for playing a Game at Our sole discretion. We reserve the right to set the maximum and minimum charge for playing a Game, and these will be updated in the rules which you can read on Our Site.
Charges to be incurred will only be valid if accepted by Our server, and subject to the Terms and Conditions herein. Until acceptance, no communications from you shall be binding, and all information displayed on this Site constitutes an invitation to play only.
You agree that We, and Our records, shall be the final authority in determining the terms of any charges you incur for playing any of the Games and the circumstances in which it was incurred.
8. Intellectual Property
You acknowledge and agree that the material on this Site is either Ours or a third party's trademark, service marks, copyright, trade secret, patent, database rights or proprietary rights provided under licence (collectively "Intellectual Property"). You agree not to download, rent, lease, loan, distribute, create derivative works, copy, re-use, modify, adapt, attempt to decompile, decipher, disassemble, reverse engineer, decrypt or discover the source code of all or any portion of this Site or any software forming part of any Game, deploy any type of query program on the Site, create improvements, or seek to obtain intellectual property protection on the content and Intellectual Property found on this Site or in any Game. You further acknowledge and agree to not use the Site or any Game in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with the Terms and Conditions set forth herein.
We grant you a personal, non-exclusive, non-transferable and non-assignable limited licence to use the software for the Games strictly to play the Games in accordance with the terms and the rules of the particular Game. You agree to follow and comply with all computer instructions and directions sent to you from Us. Such instructions that are referred to herein are incorporated hereto. Our Customer Service Team shall not be obliged to assist you should you fail to follow any instruction.
We are not seeking any remarks, suggestions, ideas, graphics, materials and other information (together a "Submission"), and although We are interested in your comments about Our products and Our company, We encourage you not to submit any such We will not be required to treat any Submission sent to Us or Our group companies as confidential, and will not be liable to you for the use of any ideas for Our business and will not incur any liability as a result of any similarities that may appear in future IGT (UK 2) Ltd's operations. All Submissions to this Site or to IGT (UK 2) Ltd are, and shall remain, Our exclusive property and may be used by Us for any purpose whatsoever, commercial or otherwise, without compensation.
9. Warranty Disclaimer And Our Liability
Your use of the Site and any of the Games is at your sole risk. The Site is provided on an "as is" and "as available" basis. Unless specifically stated herein, and except as required by law, We make no representations and expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of satisfactory quality, fitness for a particular purpose, accuracy, implied warranties of title and non-infringement.
You acknowledge and agree that We do not warrant that this Site, any Game supplied by Us or the server which makes it available shall be error-free, operate without interruption or free of viruses or other harmful components. If you become aware that the software or content contains any error, virus, or is incomplete, you shall promptly contact us so We can fix it. You agree not to take advantage of the error or virus and We reserve the right to recover any such advantage that you may gain from such error or virus, as well as all associated and reasonable costs, damages and expenses in making such recovery. You expressly acknowledge and agree that We shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, third party claims or other intangible losses (even if We have been advised of the possibility of such damages) (i) resulting from the use of, or the inability to use, the Site or any of the Games, (ii) any loss or corruption of data, (iii) communication or line failures, (iv) misuse of the Site or any of the Games by any person or (v) any error or omission in the content on the Site or any of the Games. For the avoidance of doubt, We do not limit Our liability for death or personal injury to the extent only that it arises as a result of the negligence of IGT (UK 2) Ltd , its group companies, directors, officers, employees, agents or other representatives nor do we exclude or limit our liability which arises through any fraudulent misrepresentation.
You expressly acknowledge and agree that We shall not be liable to you for the content of or use by you of any information or services offered by third parties or affiliates advertising, marketing, or otherwise posting content through Our Site or connected with any of the Games (whether directly or via hot links to or from other websites or resources) nor can We be said to endorse the content of such advertisements or information and make no warranties with respect to such content. In particular, We shall have no liability in respect of such material on Our Site or connected with any of the Games which may be misleading, inaccurate, defamatory, threatening or obscene or otherwise not in accordance with applicable laws and regulations. The provision by Us of a link to another website does not constitute any authorisation to access materials held at that location.
You agree to indemnify and hold Us harmless from any claim or demand, including reasonable legal fees, made by any third party in connection with or arising out of your use of the Site, your violation of any terms of this Site or any of the Games, your violation of applicable laws, or your violation of any rights of another person or entity.
This Site and all Games on this Site are provided to you by Us.
Save as provided elsewhere in these Terms and Conditions, in all circumstances Our maximum liability, excluding payment of valid winnings, to you for any claim in contract, tort, or in any other cause of action arising in connection with this Site, the Games or Our service shall be £1,000.

11. Rewards Programme
The Rewards programme is offered at Our sole discretion. We may revise or terminate the Rewards programme or any portion thereof. We may change or substitute redemption rewards, as well as adjust the rewards points per Game , at any time without prior notification. Your Reward point balance is usually updated once a day, overnight, but may take up to a week to be updated. Rewards points are awarded for real play on Games only that are specifically listed on the Rewards programme page. Like all non-withdrawable cash, any non-withdrawable cash obtained through a Rewards point redemption must be placed at risk on a Game before you can withdraw it. It is within Our discretion to settle any disputes related to the Rewards programme. Rewards points are only valid for a single account and cannot be transferred to other players. Players whose accounts are closed or are suspended from play forfeit their Rewards points. You may access the Rewards Programme (see the Promotions section) at any time for more information.
12. Bonus Credit
Bonus Credit can take up to 72 hours to be deposited into a Players account and is offered at Kerching Mobile Casino’s sole discretion. Kerching Mobile Casino may revise or terminate the Bonus Credit programme or any portion thereof. Any cash prizes won using promotional funds can only be redeemed using a credit or debit card. Kerching Mobile Casino may change or substitute offers, as well as adjust the offers per game, at any time without prior notification. Bonus Credit is not available for Table Games. Any non-withdrawable cash obtained through a bonus redemption must be placed at risk on a Game before you can withdraw it. It is within Kerching Mobile Casino’s discretion to settle any disputes related to the Bonus Credit programme. Bonus Credit is only valid for a single account and cannot be transferred to other players.

14. Charges
Charges for individual Games will be set out in the rules for the particular Game itself.
Your normal mobile network operator charges will apply in relation to any texts sent to Us to register via your handset, to any security texts that may be generated from the handset from time to time to verify your SIM, and in respect of any data transfer relating to the downloading by Us to you of software to your Handset in respect of Games.
You are solely responsible for any connection, use or other charges levied by your mobile network operator or internet service provider when you register to play the Games, download any associated software, play any of the Games or communicate with Us. These charges shall not be treated as charges relating to the charges levied by Us for your ability to play any of the Games.
15. Miscellaneous
Our failure, in any instance, to exercise any of Our rights under these Terms and Conditions will not constitute a general waiver of such or any other rights hereunder.
IGT-UK Group Limited trading as IGT (UK 2) Ltd is licensed and regulated by United Kingdom Gambling Commission ("UKGC". The UKGC is independent and non-political, and regulates interactive gaming on behalf of the United Kingdom Government. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales and any disputes related to these Terms and Conditions will be subject to the non-exclusive jurisdiction of the English Courts.
We reserve the right to transfer all or part of the operation of this service, to other suitably qualified and licensed parties.
By registering with Us, you consent to:
- Us collecting the following personal data, your name, date of birth, mobile phone number, mobile phone network operator, mobile phone make and model, home address, payment details (such as credit card or other relevant account identity);
- the use of such data by us for the purposes of administrating your account and contacting you with information relating to promotions, special offers and other features related to your account; and
- us sharing such data with our marketing partner in order that such companies may contact you with details of other games and services offer. To opt-out of such marketing activity, text STOP to 88821.
If, for any reason, a court of competent jurisdiction finds any provision of these Terms and Conditions, or portion thereof, unenforceable, invalid, or unlawful, then the remainder of the Terms and Conditions shall continue in full force and effect and will be read to give maximum effect to the intention of the parties as reflected by its plain language.
These Terms and Conditions constitute the entire understanding between the parties respecting use of the Site and supersede all prior or contemporaneous understandings regarding such subject matter. No amendment to or modification of these Terms and Conditions will be binding unless made by an authorised IGT (UK 2) Ltd representative acting in his or her official capacity. No third party constitutes an authorised IGT (UK 2) Ltd representative for this purpose.
These terms and conditions are not static and we reserve the right to update them or amend them from time-to-time. Any such updates or amends will be posted here in the form of an update to these terms and conditions but will also be announced on the website. You should regularly check and review these terms and conditions as your continuing use of the website will be taken by us as your continuing agreement to them. You should print out and retain a copy of these terms and conditions and retain them for your records.
